Resolving a multi-party title chain defect

Residential · Québec City · 2023

A young couple discovered, mid-transaction, that the property they were purchasing had a break in the title chain dating back to 1987. The original seller had passed away intestate, and the estate was never formally settled. Our team traced the heirs across three provinces, obtained the necessary declarations of transmission and corrected the land register entry—all within the 60-day closing window stipulated in the purchase agreement.

The result was a clean title, a satisfied lender and a couple who moved into their new home on schedule. Without timely intervention, the deal would have collapsed and the buyers would have lost their deposit.

Zoning variance for a mixed-use conversion

A developer wanted to convert a former warehouse in Saint-Roch into a mixed-use building with ground-floor retail and upper-floor residential units. The existing zoning designation did not permit residential use. We prepared a comprehensive variance application, engaged an urban planner to draft supporting studies, and presented the case at a public consultation hearing.

The municipal council granted the variance with conditions, including a commitment to preserve the building's industrial facade. Construction began six months later, and the project has since become a model for adaptive reuse in the neighbourhood. Our involvement ensured the developer met every regulatory requirement without costly delays or appeals.

Expropriation compensation for agricultural land

Agricultural · Portneuf region · 2021

A provincial highway expansion required the expropriation of 12 hectares of actively farmed land. The initial indemnity offered by the expropriating authority was based on a generic per-hectare valuation that failed to account for the property's drainage improvements, irrigation infrastructure and proximity to a regional market hub.

We retained an independent agronomy expert and a certified appraiser, whose combined report demonstrated that the land's productive value was substantially higher than the government estimate. At the Administrative Tribunal of Québec, we presented evidence of comparable sales, crop yield data and infrastructure replacement costs. The tribunal awarded our client an indemnity 87 % higher than the original offer, plus relocation assistance for the farming operation.
